News: Amazon responded in "App Store" action, requests dismissal

Amazon has in its lawsuit with Apple, the latter in which Amazon trademark infringement and unfair competition for the use of the brand "App Store" throws filed a reply . In his response, published online by GeekWire (Pdf Link), Amazon admits, open a software store with the name of choice, but denies that Apple was the app store mark, and the claims that the term "app store" generic and unprotectable. It is also on a comment by Apple CEO Steve jobs in October 2010, in which he generic say the term "app store" in a sense used, that Apple's app store "on the easiest-to-use, largest app store of the Weltvorinstalliert on each iPhone." In particular, Microsoft has trademark that review of which is still used similar arguments against Apple's "app store". Amazon asked the judge to dismiss the case, and to explain that the use of the words "app store" will not violate or diluted no rights, trademarks or otherwise of Apple. [via Mac rumors]
